THIS DOCUMENT INCLUDES WARRANTY INFORMATION (PART I) AND A SOFTWARE
PRODUCT AGREEMENT GOVERNING THE USE OF ISIS PAPYRUS SOFTWARE
(PART II).
Part I. Warranty Disclaimer.
THE SOFTWARE AND OTHER INFORMATION IS DELIVERED TO YOU “AS IS”
AND WITH ALL FAULTS. ISIS PAPYRUS DO NOT AND CANNOT WARRANT THE
PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THE SOFTWARE,
CERTIFICATE AUTHORITY SERVICES OR OTHER THIRD PARTY OFFERINGS.
EXCEPT TO THE EXTENT ANY WARRANTY, CONDITION, REPRESENTATION
OR TERM CANNOT OR MAY NOT BE EXCLUDED OR LIMITED BY LAW APPLICABLE
TO YOU IN YOUR JURISDICTION, ISIS PAPYRUS AND ITS SUPPLIERS MAKE
NO WARRANTIES CONDITIONS, REPRESENTATIONS, OR TERMS (EXPRESS
OR IMPLIED WHETHER BY STATUTE, COMMON LAW, CUSTOM, USAGE OR OTHERWISE)
AS TO ANY MATTER INCLUDING WITHOUT LIMITATION NO INFRINGEMENT
OF THIRD PARTY RIGHTS, MERCHANTABILITY, INTEGRATION, SATISFACTORY
QUALITY, OR FITNESS FOR ANY PARTICULAR PURPOSE.
Part II. Software Product Agreement.
BY USING , COPYING OR DISTRIBUTING ALL OR ANY PORTION OF THE
ISIS PAYPRUS SOFTWARE, YOU ACCEPT ALL THE TERMS AND CONDITIONS
OF THIS AGREEMENT, INCLUDING, IN PARTICULAR, THE PROVISIONS ON:
USE CONTAINED IN SECTION 2; TRANSFERABILITY IN SECTION 4; CONNECTIVITY
AND PRIVACY IN SECTION 6; WARRANTY IN SECTION 7 AND LIABILITY
IN SECTIONS 8. UPON ACCEPTANCE, THIS AGREEMENT IS ENFORCEABLE
AGAINST YOU AND ANY ENTITY THAT OBTAINED THE SOFTWARE AND ON
WHOSE BEHALF IT IS USED. IF YOU DO NOT AGREE, DO NOT USE THE
SOFTWARE.
ISIS PAPYRUS PERMITS YOU TO USE THE SOFTWARE ONLY IN ACCORDANCE
WITH THE TERMS OF THIS AGREEMENT, USE OF SOME THIRD PARTY MATERIALS
INCLUDED IN THE SOFTWARE MAY BE SUBJECT TO OTHER TERMS AND CONDITIONS
TYPICALLY FOUND IN A SEPARATE LICENSE AGREEMENT.
1. Definitions.
“ISIS Papyrus” means ISIS Papyrus Software AG, a Swiss corporation,
Weidstrasse 26, 6300 Zug, Switzerland. “Software” means (a) all
of the contents of the files (delivered electronically or on
physical media), or disk(s) or other media with which this agreement
is provided, which may include (i) ISIS Papyrus or third party
computer information or software, including the Papyrus AFP Viewer
(ii) related explanatory written materials or files (“Documentation”);
and (iii) fonts; and (b) upgrades, modified versions, updates,
additions, and copies of the foregoing, provided to you by ISIS
Papyrus at any time (collectively, “Updates”). “Use” means to
access, install, download, copy, or otherwise benefit from using
the functionality of the Software.
2. Software Product.
If you obtained the Software from ISIS Papyrus or one of its
authorized partners, and subject to your compliance with the
terms of this agreement, including the restrictions in Section
3, ISIS Papyrus grants to you a non-exclusive license to use
the Software in the manner and for the purposes described in
the Documentation as follows:
2.1 General use. You may install and use one copy of the Software
on your compatible Computer. See section 3 for important restrictions
on the use of the Software.
2.2 Server Use. This agreement does not permit you to install
or use the software on a computer file server.
2.3 Distribution. This license does not grant you the right
to sublicense or distribute the Software. For information about
obtaining the right to distribute the Software on tangible media
or through an internal network or with your product or service

2.4 Backup Copy. You may make one backup copy of the Software,
provided your backup copy is not installed or used. You may not
transfer the rights to a backup copy unless you transfer all
rights in the Software as provided under Section 4.
3. Obligations and Restrictions.
3.1 Papyrus AFP Viewer Restrictions. Papyrus AFP Viewer is licensed
and distributed by ISIS Papyrus for viewing, distributing and
sharing AFP files.
3.1.1 Conversion Restrictions. You will not integrate or use
the Papyrus AFP Viewer with any other software, plug-in when
converting or transforming AFP files into a different format
(e.g., a PDF file into a TIFF, JPEG or SVG file).
3.1.2 Plug-in Restrictions. You will not integrate or use Papyrus
AFP Viewer with any plug-in software.
3.2 Notices. Any copy of the Software that you make must contain
the same copyright and other proprietary notices that appear
on or in the Software.
3.3 No Modification or Reverse Engineering. You may not modify,
adapt, translate or create derivative works based upon the Software.
You will not reverse engineer, decompile, disassemble or otherwise
attempt to discover the source code of the Software.
4. Transfer.
You may not rent, lease, sublicense, assign or transfer your
rights in the Software, or authorize all or any portion of the
Software to be copied onto another user’s Computer except as
may be expressly permitted by this agreement. You may, however,
transfer all your rights to use the Software to another person
or legal entity provided that:
(a) you also transfer (i) this agreement, and (ii) the Software
and all other software or hardware bundled or preinstalled with
the Software, including all copies, updates and prior versions,
to such person or entity, (b) you retain no copies, including
backups and copies stored on a Computer, and (c) the receiving
party accepts the terms and conditions of this agreement and
any other terms and conditions upon which you obtained a valid
product agreement to the Software. Notwithstanding the foregoing,
you may not transfer education, pre-release, or not for resale
copies of the Software.
5. Intellectual Property Ownership, Reservation of Rights.
The Software and any authorized copies that you make are the
intellectual property of ISIS Papyrus Software AG. The structure,
organization and code of the Software are the valuable trade
secrets and confidential information of ISIS Papyrus Software
AG. The Software is protected by law, including without limitation
the copyright laws of the United States and other countries,
and by international treaty provisions. Except as expressly stated
herein, this agreement does not grant you any intellectual property
rights in the Software and all rights not expressly granted are
reserved by ISIS Papyrus.
6. Connectivity and Privacy.
6.1 Updating. You acknowledge and agree that the Software may
cause your Computer to automatically connect to the Internet
to check for updates that are available for automatic download
to your Computer and to let ISIS Papyrus know the Software is
successfully installed. Only non-personal identifying information
is transmitted to ISIS Papyrus when this happens. Your communication
with ISIS Papyrus websites is governed by the ISIS Papyrus Online
Privacy Policy.
6.2 Indemnity. You agree to hold ISIS Papyrus harmless from
any and all liabilities, losses, actions, damages, or claims
(including all reasonable expenses, costs, and attorneys fees)
arising out of or relating to any use of, or reliance on, any
service of such authority, including, without limitation (a)
reliance on an expired or revoked certificate, (b) improper verification
of a certificate, (c) use of a certificate other than as permitted
by any applicable terms and conditions, this agreement or applicable
law; (d) failure to exercise reasonable judgment under the circumstances
in relying on issuer services or certificates or (e) failure
to perform any of the obligations as required in the terms and
conditions related to the services.
7. No Warranty
The Software is being delivered to you “AS IS” and with ALL
FAULTS. ISIS PAPYRUS DOES NOT AND CANNOT WARRANT THE PERFORMANCE
OR RESULTS YOU MAY OBTAIN BY USING THE SOFTWARE, CERTIFICATE
AUTHORITY SERVICES OR OTHER THIRD PARTY OFFERINGS. EXCEPT TO
THE EXTENT ANY WARRANTY, CONDITION, REPRESENTATION OR TERM CANNOT
OR MAY NOT BE EXCLUDED OR LIMITED BY LAW APPLICABLE TO YOU IN
YOUR JURISDICTION, ISIS PAPYRUS MAKES NO WARRANTIES CONDITIONS,
REPRESENTATIONS, OR TERMS (EXPRESS OR IMPLIED WHETHER BY STATUTE,
COMMON LAW, CUSTOM, USAGE OR OTHERWISE) AS TO ANY MATTER INCLUDING
WITHOUT LIMITATION NO INFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY,
INTEGRATION, SATISFACTORY QUALITY, OR FITNESS FOR ANY PARTICULAR
PURPOSE. The provisions of Section 7 and Section 8 shall survive
the termination of this agreement, howsoever caused, but this
shall not imply or create any continued right to use the Software
after termination of this agreement.
8. Limitation of Liability.
IN NO EVENT WILL ISIS PAPYRUS BE LIABLE TO YOU FOR ANY DAMAGES,
CLAIMS OR COSTS WHATSOEVER INCLUDING ANY CONSEQUENTIAL, INDIRECT,
INCIDENTAL DAMAGES, OR ANY LOST PROFITS OR LOST SAVINGS, EVEN
IF AN ISIS PAPYRUS REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY
OF SUCH LOSS, DAMAGES OR CLAIMS. THE FOREGOING LIMITATIONS AND
EXCLUSIONS APPLY TO THE EXTENT PERMITTED BY APPLICABLE LAW IN
YOUR JURISDICTION. ISIS PAPYRUS’S AGGREGATE LIABILITY AND THAT
OF ITS SUPPLIERS AND CERTIFICATE AUTHORITIES UNDER OR IN CONNECTION
WITH THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT PAID FOR THE
SOFTWARE, IF ANY. Nothing contained in this agreement limits
ISIS Papyrus’s liability to you in the event of death or personal
injury resulting from ISIS Papyrus’s negligence or for the tort
of deceit (fraud). ISIS Papyrus is acting for the purpose of
disclaiming, excluding and/or limiting obligations, warranties
and liability as provided in this agreement, but in no other
respects and for no other purpose.
9. Export Rules.
You agree that the Software will not be shipped, transferred
or exported into any country or used in any manner prohibited
by the United States Export Administration Act or any other export
laws, restrictions or regulations (collectively the “Export Laws”).
In addition, if the Software is identified as export controlled
items under the Export Laws, you represent and warrant that you
are not a citizen, or otherwise located within, an embargoed
nation (including without limitation Iran, Syria, Sudan, Cuba
and North Korea) and that you are not otherwise prohibited under
the Export Laws from receiving the Software. All rights to use
the Software are granted on condition that such rights are forfeited
if you fail to comply with the terms of this agreement.
10. Governing Law.
This agreement will be governed by and construed in accordance
with the substantive laws in force: Switzerland. This agreement
will not be governed by the conflict of law rules of any jurisdiction
or the United Nations Convention on Contracts for the International
Sale of Goods, the application of which is expressly excluded.
11. General Provisions.
If any part of this agreement is found void and unenforceable,
it will not affect the validity of the balance of this agreement,
which shall remain valid and enforceable according to its terms.
This agreement shall not prejudice the statutory rights of any
party dealing as a consumer. This agreement may only be modified
by a writing signed by an authorized officer of ISIS Papyrus.
Updates may be offered to you by ISIS Papyrus with additional
or different terms. This is the entire agreement between ISIS
Papyrus and you relating to the Software and it supersedes any
prior representations, discussions, undertakings, communications
or advertising relating to the Software.
12. Notice to U.S. Government End Users.
For U.S. Government End Users, ISIS Papyrus agrees to comply
with all applicable equal opportunity laws including, if appropriate,
the provisions of Executive Order 11246, as amended, Section
402 of the Vietnam Era Veterans Readjustment Assistance Act of
1974 (38 USC 4212), and Section 503 of the Rehabilitation Act
of 1973, as amended, and the regulations at 41 CFR Parts 60-1
through 60-60, 60-250, and 60-741. The affirmative action clause
and regulations contained in the preceding sentence shall be
incorporated by reference in this agreement.
13. Compliance with Licenses.
If you are business or organization, you agree that upon request
from ISIS Papyrus or ISIS Papyrus’s authorized representative,
you will, within thirty (30) days, fully document and certify
that use of any and all Software at the time of the request is
in conformity with your valid software product agreement from
ISIS Papyrus.

ISIS PAYPRUS GEWÄHRT KEINE GARANTIEN, ZUSICHERUNGEN, BESTIMMUNGEN
ODER BEDINGUNGEN (AUSDRÜCKLICHER ODER STILLSCHWEIGENDER NATUR,
DIE ENTWEDER AUS DER NUTZUNG ODER EINEM HANDELSBRAUCH ENTSTEHEN,
ODER AUS GESETZLICHEN, GEWOHNHEITSRECHTLICHEN ODER ANDEREN VORSCHRIFTEN
ABGELEITET WERDEN) HINSICHTLICHE MARKTGÄNGIGKEIT, RECHTSMÄNGELFREIHEIT,
INTEGRIERUNG, ZUFRIEDENSTELLENDER QUALITÄT ODER BRAUCHBARKEIT
FÜR BESTIMMTE ZWECKE, ES SEI DENN, DERARTIGE GARANTIEN, ZUSICHERUNGEN,
BESTIMMUNGEN ODER BEDINGUNGEN SIND GEMÄSS GELTENDEM RECHT DER
JEWEILIGEN RECHTSORDNUNG VORGESCHRIEBEN UND KÖNNEN NICHT EINGESCHRÄNKT
WERDEN.

WENN SIE DIE ISIS PAPYRUS SOFTWARE VOLLSTÄNDIG ODER IN TEILEN
VERWENDEN, KOPIEREN ODER VERTREIBEN, AKZEPTIEREN SIE ALLE BESTIMMUNGEN
DIESES VERTRAGES, EINSCHLIESSLICH UND INSBESONDERE DIE FOLGENDEN
EINSCHRÄNKUNGEN: VERWENDUNG GEMÄSS ZIFFER 2, ÜBERTRAGBARKEIT
GEMÄSS ZIFFER 4, KONNEKTIVITÄT UND DATENSCHUTZ GEMÄSS ZIFFER
6, GEWÄHRLEISTUNG GEMÄSS ZIFFER 7 UND HAFTUNG GEMÄSS ZIFFERN
8. BEI ANNAHME IST DIESER VERTRAG IHNEN UND JEDER JURISTISCHEN
PERSON GEGENÜBER, DIE DIE SOFTWARE ERHALTEN HAT UND IN DEREN
NAMEN SIE GENUTZT WIRD, EINKLAGBAR. WENN SIE DEN BEDINGUNGEN
NICHT ZUSTIMMEN, VERWENDEN SIE DIESE SOFTWARE BITTE NICHT.
ISIS PAPYRUS ERLAUBT IHNEN DIE VERWENDUNG DER SOFTWARE NUR GEMÄSS
DEN BESTIMMUNGEN DIESES VERTRAGS. PRODUKTE VON DRITTEN, DIE IN
DER SOFTWARE ENTHALTEN SIND, KÖNNEN ANDEREN GESCHÄFTSBEDINGUNGEN
UNTERLIEGEN. INFORMATIONEN HIERZU FINDEN SIE NORMALERWEISE IN
FORM EINES SEPARATEN PRODUKTVERTRAGS.
1. Definitionen
ISIS Papyrus Software AG, eine Schweizer Gesellschaft mit Hauptsitz
in der Weidgasse 26, 6300 Zug, Schweiz. “Software” umfasst (a)
den gesamten Inhalt der Dateien (gleich ob elektronisch oder
auf physischen Datenträgern bereitgestellt), der Diskette(n)
oder eines anderen Datenträgers, mit dem dieser Vertrag geliefert
wird. Dazugehörige Begleitmaterialien oder Dateien (“Dokumentation”)
sowie alle Upgrades, modifizierten Versionen, Updates, Ergänzungen
sowie deren Kopien, die Ihnen ISIS Papyrus zu irgendeinem Zeitpunkt
zur Verfügung stellt (zusammenfassend “Updates”). Der Begriff
“Verwendung” bezieht sich auf den Zugriff, die Installation,
das Herunterladen, das Kopieren oder eine anderweitige Nutzung
der Funktionen der Software.
2. Softwareprodukt
Sofern Sie die Software von ISIS Papyrus bezogen haben und solange
Sie die Bestimmungen diese Vertrages, einschließlich der Beschränkungen
aus Absatz 3, einhalten, gewährt Ihnen ISIS Papyrus die Nutzung
eines Software Produktes wie in der Dokumentation beschriebenen
und zu den darin beschriebenen Zwecken gemäß den nachfolgenden
Bestimmungen.
2.1. Allgemeine Verwendung. Sie dürfen eine Kopie der Software
auf Ihrem kompatiblen Computer installieren und verwenden. Wichtige
Beschränkungen bei der Verwendung der Software finden Sie in
Ziffer 3.
2.2. Serververwendung. Dieser Vertrag berechtigt Sie nicht zur
Installation oder Verwendung der Software auf einem Dateiserver
eines Computers.
2.3. Verbreitung. Dieser Vertrag berechtigt Sie nicht zur Unterlizenzierung
oder zum Vertrieb der Software. Informationen zur Erlangung des
Rechts zum Vertrieb der Software auf beweglichen Datenträgern
oder über ein internes Netzwerk oder mit Ihrem Produkt oder Dienst
finden Sie unter

2.4. Sicherungskopie. Sie sind zur Erstellung einer Sicherungskopie
der Software unter der Voraussetzung berechtigt, dass diese Sicherungskopie
nicht installiert oder verwendet wird. Eine Übertragung der Rechte
zur Erstellung einer Sicherungskopie ist nicht zulässig, es sei
denn, es werden sämtliche Rechte an der Software gemäß Ziffer
4 übertragen.
3. Verpflichtungen und Enschränkungen
3.1 ISIS Papyrus AFP Viewer Nutzungsbeschränkungen. Der Papyrus
AFP Viewer wird von ISIS Papyrus zur Anzeige, Veröffentlichung
und gemeinsamen Nutzung von AFP-Dateien als Produkt vergeben
und verteilt.
3.2.1 Konvertierungsbeschränkungen. Sie sind nicht befugt, den
Papyrus AFP Viewer mit anderer Software, Plug.Ins oder Erweiterungen
zu integrieren oder zu verwenden, die sich bei der Konvertierung
oder Umwandlung von AFP-Dateien in ein anderes Dateiformat auf
den Papyrus AFP Viewer stützen oder diesen verwenden (z.B. die
Konvertierung von AFP-Dateien in TIFF-, JPEG- oder SVG-Dateien).
3.2.2 Plug.In-Beschränkungen. Ferner sind Sie nicht berechtigt,
den Papyrus AFP Viewer mit Plug-In-Software zu integrieren oder
zu verwenden, die nicht gemäß dem Papyrus Integration Key-Produktvertrag
entwickelt wurde.
3.3 Schutzvermerke. Jede Kopie der Software, die Sie anfertigen,
muss dieselben Urheberrechts- und Schutzrechtsvermerke tragen,
die auch auf oder in der Software selbst vorhanden sind.
3.4 Keine Modifizierung oder Rückentwicklung. Das Ändern, Anpassen,
Übersetzen oder Erstellen von Bearbeitungen der Software ist
Ihnen nicht gestattet. Sie dürfen die Software nicht zurückentwickeln,
dekompilieren bzw. disassemblieren oder auf andere Weise versuchen
, den Quellcode der Software zu ermitteln.
4. Übertragung
Mit Ausnahme der in diesem Vertrag ausdrücklich erlaubten Fälle
dürfen Sie die Rechte am Softwareprodukt nicht vermieten, verleihen,
unterlizenzieren, abtreten oder übertragen oder das Kopieren
der Software weder in Teilen noch als Ganzes auf den Computer
eines anderen Benutzers genehmigen. Sie dürfen jedoch alle Ihre
Rechte zur Verwendung der Software auf eine andere natürliche
oder juristische Person unter der Voraussetzung übertragen, dass:
(a) Sie den (i) vorliegenden Vertrag und (ii) die Software und
sonstige Software oder Hardware, die mit der Software gebündelt
oder auf dieser vorinstalliert ist, einschließlich aller Kopien,
Updates und früheren Versionen an diese natürliche oder juristische
Person übertragen, (b) Sie keine Kopien, einschließlich Sicherungskopien
und sonstiger Kopien, die auf einem Computer gespeichert sind,
zurückbehalten und (c) der Empfänger die Bestimmungen dieses
Vertrages sowie sonstige Bestimmungen akzeptiert, nach denen
Sie ein Softwareprodukt erworben haben. Ungeachtet der vorstehenden
Ausführungen, dürfen Sie keine Schulungs-, Vorab- oder Musterkopien
der Software übertragen.
5. Rechte an geistigem Eigentum, Rechtsvorbehalte
Die Software und sämtliche autorisierten Kopien dieser Software,
die Sie anfertigen, sind geistiges Eigentum von ISIS Papyrus
Software AG.. Struktur, Organisation und Code der Software stellen
wertvolle Betriebsgeheimnisse und vertrauliche Informationen
von ISIS Papyrus Software AG dar. Die Software ist gesetzlich
geschützt, einschließlich des Urheberrechts der Schweiz und anderer
Länder sowie durch internationale Verträge. Ausgenommen der vorliegenden
Ausführungen, gewährt Ihnen dieser Vertrag keinerlei geistige
Eigentumsrechte an der Software, und alle nicht ausdrücklich
gewährten Rechte sind ISIS Papyrus vorbehalten.
6. Konnektivität und Datenschutz
6.1 Aktualisierungen. Sie geben Ihre Zustimmung dazu, dass die
Software Ihren Computer dazu veranlassen kann, automatisch eine
Verbindung zum Internet herzustellen, um zu überprüfen, ob Updates
zum automatischen Herunterladen auf Ihren Computer verfügbar
sind, und ISIS Papyrus zu melden, dass die Software erfolgreich
installiert wurde. In diesem Fall werden ISIS Papyrus nur nicht
personenbezogene Erkennungsinformationen übermittelt. Ihre Kommunikation
mit Websites von ISIS Papyrus unterliegt der Richtlinie für den
Online-Datenschutz von ISIS Papyrus. Informationen zum Ändern
standardmäßiger Aktualisierungseinstellungen finden Sie in der
Dokumentation.
7. Gewährleistungsausschluss
Die Software wird “WIE BESEHEN” und mit ALLEN MÄNGELN zur Verfügung
gestellt. ISIS PAPYRUS KANN KEINE GEWÄHRLEISTUNG FÜR DIE LEISTUNGSFÄHIGKEIT
DER SOFTWARE ODER DIE ERZIELTEN ARBEITSERGEBNISSE BEI VERWENDUNG
DER SOFTWARE BZW. BEI INANSPRUCHNAHME VON DIENSTEN VON ZERTIFIZIERUNGSDIENSTANBIETERN
ODER ANDEREN ANGEBOTEN DRITTER ÜBERNEHMEN. ISIS PAPYRUS, SEINE
LIEFERANTEN GEWÄHREN KEINE GARANTIEN, ZUSICHERUNGEN, BESTIMMUNGEN
ODER BEDINGUNGEN (AUSDRÜCKLICHER ODER STILLSCHWEIGENDER NATUR,

ODER AUS GESETZLICHEN, GEWOHNHEITSRECHTLICHEN ODER ANDEREN VORSCHRIFTEN
ABGELEITET WERDEN) HINSICHTLICH MARKTGÄNGIGKEIT, RECHTSMÄNGELFREIHEIT,
INTEGRIERUNG, ZUFRIEDENSTELLENDER QUALITÄT ODER BRAUCHBARKEIT
FÜR BESTIMMTE ZWECKE, ES SEI DENN, DERARTIGE GARANTIEN, ZUSICHERUNGEN,
BESTIMMUNGEN ODER BEDINGUNGEN SIND GEMÄSS GELTENDEM RECHT DER
JEWEILIGEN RECHTSORDNUNG VORGESCHRIEBEN UND KÖNNEN NICHT EINGESCHRÄNKT
WERDEN. Die Bestimmungen in Ziffern 9 und 10 gelten über die
Beendigung dieses Vertrags hinaus fort, ungeachtet der Gründe
für die Beendigung. Daraus folgt jedoch weder stillschweigend
noch ausdrücklich die Gewährung eines Nutzungsrechts an der Software
für die Zeit nach Beendigung dieses Vertrags.
8. Haftungsbeschränkung
ISIS PAPYRUS UND SEINE LIEFERANTEN ÜBERNEHMEN KEINE HAFTUNG
FÜR SCHÄDEN, ANSPRÜCHE ODER KOSTEN JEGLICHER ART, EINSCHLIESSLICH
FOLGESCHÄDEN, MITTELBARE ODER ZUFÄLLIGE SCHÄDEN FÜR ENTGANGENEN
GEWINN BZW. VERLUSTE, AUCH WENN EIN VERTRETER VON ISIS PAPYURS
ÜBER DIE MÖGLICHKEIT SOLCHER VERLUSTE, SCHÄDEN ODER ANSPRÜCHE
UNTERRICHTET WAR. DIE VORGENANNTEN BESCHRÄNKUNGEN UND AUSSCHLÜSSE
GELTEN NUR SOWEIT NACH ANWENDBAREN ZWINGENDEN VORSCHRIFTEN DES
NATIONALEN RECHTS ALS ZULÄSSIG. DIE GESAMTE HAFTUNG VON ISIS
PAPYRUS, UND SEINEN LIEFERANTEN IM RAHMEN DIESES VERTRAGES IST
AUF DEN BETRAG BEGRENZT, DER GEGEBENENFALLS FÜR DIE SOFTWARE
ENTRICHTET WURDE. Nicht beschränkt wird im Rahmen dieses Vertrags
die Haftung im Falle von Tod oder Verletzung von Personen, wenn
dies auf Fahrlässigkeit oder arglistige Täuschung seitens ISIS
Papyrus zurückzuführen ist. ISIS Papyrus handelt im Namen seiner
Lieferanten und Zertifizierungsdienstanbieter ausschließlich
zum Zweck der Ablehnung, des Ausschlusses und/oder der Einschränkung
von Verpflichtungen, Gewährleistungen oder Haftung gemäß diesem
Vertrag, ansonsten aber handelt ISIS Papyrus nicht in deren Auftrag.
9 Exportbestimmungen
Sie verpflichten sich, die Software nicht auf eine Weise zu
verwenden bzw. nicht in ein Land zu versenden, zu übertragen
oder auszuführen, in das laut Ausfuhrbestimmungen der Schweiz
bzw. anderer Ausfuhrgesetze, -beschränkungen oder -regelungen
(im Folgenden als “Ausfuhrgesetze” bezeichnet) eine Ausfuhr untersagt
ist. Unterliegt die Software darüber hinaus der Ausfuhrkontrolle
gemäß den Ausfuhrgesetzen, sichern Sie zu, dass Sie weder Staatsangehöriger
noch Ansässiger eines Landes sind, für das ein Embargo verhängt
wurde (einschließlich, aber nicht beschränkt auf, Iran, Syrien,
Sudan, Kuba und Nordkorea) und für Sie kein Verbot nach den Ausfuhrgesetzen
gilt, die Software eintgegenzunehmen. Alle Rechte zur Verwendung
der Software werden unter der Bedingung gewährt, dass diese Rechte
verwirkt werden, wenn Sie sich nicht an die Bedingungen dieses
Vertrags halten.
10. Geltendes Recht
Dieser Vertrag unterliegt dem geltenden materiellen Recht der
Schweiz.
11. Allgemeine Bestimmungen
Für den Fall, dass eine Bestimmung dieses Vertrages für nichtig
und undurchführbar erachtet wird, so ist die Gültigkeit der übrigen
Bestimmungen dieses Vertrages hiervon nicht betroffen, der ansonsten
gemäß seinen Bestimmungen gültig und durchführbar bleibt. Dieser
Vertrag darf die gesetzlichen Rechte keiner Partei beeinträchtigen,
die als Verbraucher handelt. Eine Änderung des vorliegenden Vertrags
ist nur in schriftlicher Form zulässig, die von einem bevollmächtigten
Vertreter von ISIS Papyrus Software AG unterzeichnet werden muss.
Von ISIS Papyrus gewährte Updates können zusätzliche bzw. andere
Bestimmungen enthalten. Dies ist der vollständige Vertrag zwischen
Ihnen und ISIS Papyrus bezüglich der Software. Er ersetzt alle
bisherigen Erklärungen, Besprechungen, Zusicherungen, Mitteilungen
oder Werbungen mit Bezug zur Software.
12. Hinweis für US-Behörden als Endnutzer
Ist der Endnutzer eine US-Regierungsbehörde, so verpflichtet
sich ISIS Papyrus, alle anwendbaren Gesetze zur Chancengleichheit
anzuwenden, einschließlich der Bestimmungen der Executive Order
11246, einschließlich Ergänzungen, Abschnitt 402 des Vietnam
Era Veterans Readjustment Assistance Act von 1974 (38 USC 4212),
und Abschnitt 503 des Rehabilitation Act von 1973, einschließlich
Ergänzungen, sowie den Vorschriften in 41 CFR, 60-1 bis 60-60,
60-250 und 60-741. Die Gesetze und Vorschriften über aktive Förderungsmaßnahmen
zugunsten von Minderheiten im vorgenannten Satz sind als Bezug
in diesen Vertrag aufzunehmen.
13. Beachtung von Produkten
Unternehmen und Organisationen sind hiermit verpflichtet, nach
Aufforderung von ISIS Papyrus oder einem Bevollmächtigten von
ISIS Papyrus innerhalb von dreißig (30) Tagen vollständig zu
belegen und zu bestätigen, dass die Verwendung jedweder Software
zum Zeitpunkt der Anfrage gemäß den Bestimmungen gültiger ISIS
Papyrus Produkt Geschäftsbedingungen erfolgt.
